{"id":3860,"date":"2025-02-21T16:54:30","date_gmt":"2025-02-21T05:54:30","guid":{"rendered":"https:\/\/wiselinkaccountants.com.au\/?p=3860"},"modified":"2025-02-21T16:54:38","modified_gmt":"2025-02-21T05:54:38","slug":"critical-minerals-production-tax-incentive","status":"publish","type":"post","link":"https:\/\/wiselinkaccountants.com.au\/zh-hans\/critical-minerals-production-tax-incentive\/","title":{"rendered":"Critical Minerals Production Tax Incentive"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"ato-Abouttheincentive\">About the incentive<\/h2>\n\n\n\n<p>In the 2024\u201325 Budget, the Australian Government announced its\u00a0<a href=\"https:\/\/parlinfo.aph.gov.au\/parlInfo\/search\/display\/display.w3p;query=Id%3A%22legislation%2Fems%2Fr7297_ems_00fa0e2e-bb91-4c72-9a66-086436d63677%22\" target=\"_blank\" rel=\"noreferrer noopener\">Future Made in Australia<\/a> package. This package supports Australia&#8217;s transition to a net zero economy.<\/p>\n\n\n\n<p>The&nbsp;<em>Future Made in Australia<\/em>&nbsp;package includes support for investment in critical minerals processing in Australia through the Critical Minerals Production Tax Incentive (CMPTI). This measure is now law.<\/p>\n\n\n\n<p>The CMPTI provides eligible recipients with a refundable tax offset of 10&nbsp;per cent of the eligible costs of processing certain&nbsp;critical minerals in Australia. The offset will be available between 1&nbsp;July 2027 and 30&nbsp;June 2040, for a maximum of 10&nbsp;years.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Administration<\/h3>\n\n\n\n<p>The Department of Industry, Science and Resources (DISR) and the ATO jointly administer the CMPTI:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Industry Secretary (DISR) registers the CMPTI processing activities.<\/li>\n\n\n\n<li>We administer the CMPTI tax offset claimed in your company tax return.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ato-Eligibility\"><a><\/a>Eligibility<\/h2>\n\n\n\n<p>You are eligible for the CMPTI tax offset in an income year if you:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>are a constitutional corporation conducting a registered processing activity during the year<\/li>\n\n\n\n<li>incur certain expenditure in carrying on the processing activity<\/li>\n\n\n\n<li>meet the residency requirement.<\/li>\n<\/ul>\n\n\n\n<p>Your company must be an Australian tax resident, or a foreign resident carrying on the processing activity via a permanent establishment in Australia, and it has an ABN, for the income year.<\/p>\n\n\n\n<p>Your company will also have to comply with any rules implementing the community benefit principles for the CMPTI made by the Treasurer.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Critical minerals list<\/h3>\n\n\n\n<p>For the purposes of the CMPTI tax offset, a critical mineral is a thing included in the list specified in the legislation or prescribed in the regulations.<\/p>\n\n\n\n<p>There are 31\u00a0critical minerals listed in the legislation. See the\u00a0<a href=\"https:\/\/www.industry.gov.au\/publications\/australias-critical-minerals-list-and-strategic-materials-list\" target=\"_blank\" rel=\"noreferrer noopener\">Australia\u2019s Critical Minerals List<\/a>\u00a0on the DISR website.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ato-CMPTIprocessingactivities\"><a><\/a>CMPTI processing activities<\/h2>\n\n\n\n<p>CMPTI processing activities are processing activities carried on at one or more facilities in Australia that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>involve substantially transforming a feedstock that contains a critical mineral into a purer or more refined form of the critical mineral that is chemically distinct from the feedstock, and a substantial purpose for carrying on the activity is to achieve this transformation, or<\/li>\n\n\n\n<li>are specified in the regulations as producing an outcome in relation to one or more critical minerals.<\/li>\n<\/ul>\n\n\n\n<p>Certain activities, such as mining, beneficiation and manufacturing are excluded from being CMPTI processing activities.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ato-Howtoclaim\"><a><\/a>How to claim<\/h2>\n\n\n\n<p>You must register your company&#8217;s processing activities for the relevant income year.<\/p>\n\n\n\n<p>You self-assess your company&#8217;s CMPTI tax offset amount and claim in the company tax return for the income year.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Registered processing activity<\/h3>\n\n\n\n<p>For an activity to become a registered CMPTI processing activity, the company must apply to the Industry Secretary (DISR), in the approved form, to register the relevant activities. DISR will provide information on the\u00a0<a href=\"https:\/\/www.industry.gov.au\/mining-oil-and-gas\/minerals\/critical-minerals\" target=\"_blank\" rel=\"noreferrer noopener\">registration process<\/a>\u00a0as it becomes available.<\/p>\n\n\n\n<p>Your application must identify the:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>critical mineral processing activity<\/li>\n\n\n\n<li>facilities at which the activity occurs<\/li>\n\n\n\n<li>basis on which the company considers it will satisfy the requirements to be eligible for the CMPTI tax offset.<\/li>\n<\/ul>\n\n\n\n<p>You may register a processing activity for up to 10&nbsp;years. There are annual requirements to maintain the registration.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ato-Whatyoucanclaim\"><a><\/a>What you can claim<\/h2>\n\n\n\n<p>The amount of the CMPTI tax offset for an income year is 10&nbsp;per cent of the company&#8217;s CMPTI expenditure.<\/p>\n\n\n\n<p>CMPTI expenditure is expenditure incurred by the company during an income year in carrying on one or more of its registered CMPTI processing activities and is not excluded expenditure.<\/p>\n\n\n\n<p>Excluded expenditure includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>capital expenditure<\/li>\n\n\n\n<li>financing expenditure<\/li>\n\n\n\n<li>feedstock<\/li>\n\n\n\n<li>expenditure taken into account when calculating decline in value of an asset for the purposes of taxation law<\/li>\n\n\n\n<li>expenditure for intellectual property that is more than 10\u00a0per cent of the company&#8217;s CMPTI expenditure for the income year, and<\/li>\n\n\n\n<li>any other expenditure excluded as prescribed by the Regulations.<\/li>\n<\/ul>\n\n\n\n<p>Note: amounts of expenditure up to the 10&nbsp;per cent cap for intellectual property may be included to the extent that it is CMPTI expenditure.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ato-Whentoclaim\"><a><\/a>When to claim<\/h2>\n\n\n\n<p>You can claim the CMPTI tax offset for income years that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>start on or after 1\u00a0July 2027, and<\/li>\n\n\n\n<li>end on or before 30\u00a0June 2040.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>About the incentive In the 2024\u201325 Budget, the Australian Government announced its\u00a0Future Made in Australia package.
